When you set up an account with Zealthy or use our Services, you are creating a direct customer relationship with Zealthy that enables you to access and/or utilize the various functions of the Platform and the Service as a user. As part of that relationship, you provide information to Zealthy, including but not limited to, your name, email address, shipping address, phone number and certain transactional information, that we do not consider to be “protected health information” or “medical information”.
However, in using certain components of the Service, you may also provide certain health or medical information that may be protected under applicable laws. Zealthy itself is not a “covered entity” under the Health Insurance Portability and Accountability Act of 1996, Public Law 104-191, and its related regulations and amendments from time to time (collectively, “HIPAA”). One or more of the medical group service Providers (as defined in our Terms and Conditions) may be a “covered entity” under HIPAA, and Zealthy may in some cases be a “business associate” of a Provider. It is important to note that HIPAA does not necessarily apply to an entity or person simply because there is health information involved, and HIPAA may not apply to your transactions or communications with Zealthy or the Providers involved in providing medical services.
To the extent Zealthy is legally considered a HIPAA “business associate,” and solely in such role as a business associate, Zealthy, may be subject to certain provisions of HIPAA with respect to “protected health information,” as defined under HIPAA, that you provide to Zealthy or service Providers (“PHI”). In addition, any medical or health information that you provide may be subject to specific protections under applicable state laws (collectively, with PHI,
Protected Information”). Any Protected Information will be used and disclosed only in accordance with such applicable laws. However, any information that does not constitute Protected Information under applicable laws may be used or disclosed in any manner permitted under this Privacy Policy. Protected Information does not include information that has been de-identitified in accordance with applicable laws.
By accessing or using any part of the Service, you understand that even if HIPAA does apply to Zealthy or any of the Service providers, any information that you submit to Zealthy that is not intended and used solely for the provision of diagnosis and treatment by the Providers, is not considered Protected Information, and will only be subject to our Privacy Policy and any applicable state laws that govern the privacy and security of such information. For purposes of clarity, information you provide to Zealthy to register and set up an account on the Platform, including name, username, email address, shipping address and phone number, are not typically considered Protected Information.
For information about how we handle your medical information or protected health information, please refer to our Notice of Privacy Practices.

We may use cookies, web beacons, mobile analytics and advertising IDs, and similar technologies to operate our websites and online services and to help collect data, including usage data, identifiers and device information.
Cookies are small text files placed by a website and stored by your browser on your device. A cookie can later be read when your browser connects to a web server in the same domain that placed the cookie. The text in a cookie contains a string of numbers and letters that may uniquely identify your device and can contain other information as well. This allows the web server to recognize your browser over time, each time it connects to that web server.
Web beacons are electronic images (also called single-pixel or clear GIFs) that are contained within a website or email. When your browser opens a webpage or email that contains a web beacon, it automatically connects to the web server that hosts the image (typically operated by a third party). This allows that web server to log information about your device and to set and read its own cookies. In the same way, third-party content on our websites (such as embedded videos, plug-ins, or ads) results in your browser connecting to the third-party web server that hosts that content. We also include web beacons in our email messages or newsletters to tell us if you open and act on them.
Mobile analytics and advertising IDs are generated by operating systems for mobile devices (iOS and Android) and can be accessed and used by apps in much the same way that websites access and use cookies. Our apps contain software that enables us and our third-party analytics and advertising partners to access these mobile IDs.
We, and our analytics and advertising partners, use these technologies in our websites, apps, and online services to collect personal data (such as the pages you visit, the links you click on, and similar usage information, identifiers, and device information) when you use our services, including personal data about your online activities over time and across different websites or online services. This data is used to store your preferences and settings, enable you to sign-in, analyze how our websites and apps perform, track your interaction with the site or app, develop inferences, deliver, and tailor interest-based advertising, combat fraud, and fulfill other legitimate purposes. We and/or our partners also share the data we collect or infer with third parties for these purposes. For more information about the third-party analytics and advertising partners that collect personal information on our services, please see Section 6 below.
There are a range of cookie and related controls available through browsers, mobile operating systems, and elsewhere. See Section 10 below for details.

International Residents. Our Service is hosted in the United States and intended for visitors located within the United States. If you choose to use the Service from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then you acknowledge and consent that you are transferring your personal information outside of those regions to the United States for storage and processing, and that such transfers will be conducted in accordance with applicable data protection laws including, where applicable, the EU Standard Contractual Clauses or other appropriate transfer mechanisms. Also, we may transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the Service. By providing any information, including personal information, on or to the Service, you consent to such transfer, storage, and processing. Further, you acknowledge that your continued use of the Service is governed by U.S. law and regulation, this Policy and our Terms of Service.
If you are a resident in the European Union and you believe we are unlawfully processing your personal information, you also have the right to complain to your local data protection supervisory authority. Cookie Controls. Most web browsers are set to accept cookies by default. If you prefer, you can go to your browser settings to learn how to delete or reject cookies. If you choose to delete or reject cookies, this could affect certain features or services of our website. If you choose to delete cookies, settings and preferences controlled by those cookies, including advertising preferences, may be deleted and may need to be recreated.
Global Privacy Control. Some browsers and browser extensions support the “Global Privacy Control” (GPC) or similar controls that can send a signal to the websites you visit indicating your choice to opt-out from certain types of data processing, including data sales and/or targeted advertising, as specified by applicable law. When we detect such a signal, we will make reasonable efforts to respect your choices indicated by a GPC setting or similar control that is recognized by regulation or otherwise widely acknowledged as a valid opt-out preference signal.
Do Not Track. Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.
Mobile Advertising ID Controls. iOS and Android operating systems provide options to limit tracking and/or reset the advertising IDs.
Email Web Beacons. Most email clients have settings that allow you to prevent the automatic downloading of images, including web beacons, which prevents the automatic connection to the web servers that hose those images.
Except for the automated controls described above, if you send us a request to exercise your rights or these choices, to the extent permitted by applicable law, we may decline requests in certain cases. For example, we may decline requests where granting the request would be prohibited by law, could adversely affect the privacy or other rights of another person, would reveal a trade secret or other confidential information, or would interfere with a legal or business obligation that requires retention or use of the data. Further, we may decline a request where we are unable to authenticate you as the person to whom the data relates, whether the request is unreasonable or excessive, or where otherwise permitted by applicable law.
Finally, please note that this Privacy Policy applies only to your “personal information,” which is separate from “medical information” or “protected health information” as defined under HIPAA and other applicable healthcare privacy laws. For information about how we handle your medical information or protected health information, please refer to our Notice of Privacy Practices.
We may update this Privacy Policy from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. If we make material changes to this Privacy Policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this Privacy Policy frequently to be informed of how we are protecting your information.
If you have questions or comments about this Privacy Policy, you may email us at support@getzealthy.com
